On September 25, 2025, the Official Journal of the European Union (OJ) published Amendment (EU) 2025/1930 to the POPs Regulation (EU) 2019/1021, introducing new control requirements for decabromodiphenyl ether (DPE). This amendment will take effect on October 15, 2025. Consequently, the list of restricted substances in Part A of Annex I to the POPs Regulation has been updated to include 32 substances.

1. For the purposes of this entry, Article 4(1)(b) applies to substances, mixtures, or articles.
(a) Before April 15, 2028, DP concentration ≤ 1000 mg/kg (0.1% by mass);
(b) After April 15, 2028, DP concentration ≤ 1 mg/kg (0.0001% by mass);
2. As an exception, articles containing dechlorine may be placed on the market and used for the following purposes:
(a) Aerospace, space, and defense applications, until February 26, 2030;
(b) Medical imaging applications, until February 26, 2030;
(c) Radiotherapy equipment and devices, until February 26, 2030;
(d) Spare parts and maintenance for any of the following equipment:
(i) Land-based mobile vehicles;
(ii) Stationary industrial machinery for agriculture, forestry, and construction;
(iii) Marine, garden, forestry, and outdoor power equipment other than those referred to in (ii);
(iv) Aerospace, space, and defense applications;
(v) Instruments for analysis, measurement, control, monitoring, testing, production, and inspection;
If Declon was originally used in the production of the above equipment, the exemption period extends until the end of its useful life or December 31, 2043, whichever comes first.
(e) Spare parts and maintenance for any of the following devices:
(i) Medical devices and their accessories falling within the scope of Regulation (EU) 2017/745;
(ii) In vitro diagnostic medical devices and their accessories falling within the scope of Regulation (EU) 2017/746.
3. The Commission shall assess no later than April 1, 2028 whether it is necessary to extend the specific exemptions referred to in points (a), (b), and (c) of paragraph 2;
4. Articles containing dechlorine that are already in use within the EU may continue to be used on or before the date of expiry of the relevant exemptions provided for in points (a) to (d) of paragraph 2;
5. Spare parts containing decabromodiphenyl ether as described in paragraph 2(d)(iv) that entered the EU on or before December 31, 2043, shall be permitted to be placed on the market and used.
