On December 6, 2024, the California Office of Environmental Health Hazard Assessment (OEHHA) published on its website the final text of the California Proposition 65 Short Form Warning Label, which amends sections 25601, 25602, 25603, and 25607.2 of Chapter 6 of Title 27 of the California Proposition 65 Code of Regulations, “Clear and Reasonable Warning Labels – Safe Harbor Methods and Contents”, and adds new sections 25607.50, 25607.51, 25607.52, and 25607.53, which will become effective on 01 January 2025 and mandatory on 01 January 2028.
The major updates are listed below:
- Abbreviated warnings require at least one chemical name to be added to provide more information to consumers;
- Providing additional warning options for businesses to choose from, such as the option to use “CA WARNING” in addition to the original “WARNING” or”CALIFORNIA WARNING”;
- Allow businesses that currently rely on existing short warnings to transition to the new short warning content within three years;
- Clarify that short warnings can be used to provide safe harbour warnings for food;
- For products purchased online before 01 January 2028, retailers have a 60-day transition period to update online short warnings after receiving a warning or written notice from the manufacturer;
- New customised safe harbour warnings for passenger or off-highway motor vehicle parts and leisure boat parts.
